Terms of Use
Terms of use for Minurattad Marketplace: listings, buying and selling, payments, delivery and user obligations.
NBBy publishing a listing or completing a purchase the user confirms that they have read these terms and agree to follow them.
1. General provisions
1.1. Minurattad Marketplace is an online platform that allows users to sell and buy tyres, rims, and other goods permitted by the platform.
1.2. Minurattad.ee acts as an intermediary in transactions and provides a platform for publishing listings, arranging purchases and sales, processing payments, and coordinating logistics.
1.3. By adding a listing or completing a purchase, the user confirms that they have read these terms and agree to comply with them.
2. Rules for publishing listings
2.1. The seller may publish only goods that they legally own or that they are entitled to sell.
2.2. All information provided in a listing must be true and reflect the actual condition of the goods.
2.3. For tyres, the following information is mandatory:
- tyre size;
- seasonal category;
- number of tyres;
- DOT marking;
- remaining tread depth;
- known damage.
2.4. It is not permitted to list tyres with a tread depth below 4 mm or tyres that are older than 10 years according to the DOT marking.
2.5. For rims, the following information is mandatory:
- rim size;
- number of rims;
- rim material;
- bolt pattern;
- known damage.
2.6. Photos must show the actual goods being sold.
3. Prohibited activities
3.1. Listings may not include:
- phone numbers;
- email addresses;
- website links;
- social media links;
- QR codes;
- company advertisements;
- photos containing contact details.
3.2. It is prohibited to direct buyers or sellers to complete a transaction outside Minurattad.ee Marketplace.
3.3. It is prohibited to provide false information about the condition, quantity, or characteristics of the goods.
4. Moderation
4.1. All listings may be moderated before publication.
4.2. Minurattad.ee has the right to:
- reject a listing;
- request additional photos;
- change the category of a listing;
- remove a listing;
- restrict a user’s access to the platform.
4.3. After a listing is edited, it is sent for moderation again.
5. Secure transaction
5.1. All Marketplace transactions are carried out through Minurattad.ee.
5.2. The buyer pays for the order through Minurattad.ee.
5.3. The transaction amount is kept under the control of Minurattad.ee until the transaction has been successfully completed.
5.4. Minurattad.ee has the right to suspend a payout in the event of a dispute or review.
6. Delivery
6.1. Transport of the goods is arranged by Minurattad.ee or its cooperation partner.
6.2. The buyer pays the delivery fee unless otherwise specified.
6.3. The seller is required to package the goods properly.
6.4. The seller is required to prepare the goods and hand them over within 2 business days of order confirmation, in accordance with the instructions of Minurattad.ee.
6.5. If the seller is unable to hand over the goods on time, Minurattad.ee has the right to cancel the transaction.
6.6. If the transaction is cancelled, the amount paid by the buyer is refunded in full.
6.7. The seller is responsible for damage occurring during transport of the goods that is caused by inadequate packaging.
6.8. For damage occurring during transport of the goods that is not related to packaging, the carrier is responsible in accordance with its terms and applicable law.
7. Service fee
7.1. Adding a listing is free of charge.
7.2. In the event of a successful sale, a service fee of 5% of the total selling price of the products applies, but not less than 5 euros per order.
Examples:
- €40 order → service fee €5;
- €80 order → service fee €5;
- €100 order → service fee €5;
- €200 order → service fee €10;
- €500 order → service fee €25.
7.3. If products from multiple sellers are purchased within a single order, the service fee is calculated separately for each seller based only on the total selling price of that seller's products.
7.4. The service fee is withheld before the money is paid out to the seller.
7.5. Minurattad.ee has the right to change the service fee terms, notifying users via information published on the website.
7.6. Only the selling price of products is used as the basis for calculating the service fee. The delivery fee, transport fee, or any other delivery-related surcharge is not included in the service fee calculation.
8. Payouts to the seller
8.1. Payout to the seller takes place within 7 days after the buyer has received the goods.
8.2. The payout is made from the selling price, from which the service fee has been deducted in accordance with section 7.
8.3. Minurattad.ee has the right to suspend a payout if a dispute, return, or review has been initiated in respect of the transaction. In such case, the payout takes place after the dispute or review has ended.
8.4. If the buyer validly exercises the right of withdrawal after the payout has been made, the seller is required to return the received amount to Minurattad.ee within 7 business days. Minurattad.ee has the right to offset this amount against the seller's future payouts.
9. Right of withdrawal
9.1. A consumer buyer has the right to withdraw from the transaction within 14 days of receiving the goods, without giving a reason (VÕS § 56).
9.2. The right of withdrawal does not apply to a buyer who is a legal entity or who makes the purchase in the course of economic or professional activity.
9.3. To withdraw, the buyer submits a notice through Minurattad.ee within 14 days of receiving the goods. The buyer returns the goods no later than 14 days after submitting the notice.
9.4. Returned goods must be in the same condition in which they were handed over to the buyer. The buyer is responsible for any reduction in the value of the goods resulting from use beyond what is necessary to establish the nature and characteristics of the goods. Mounting tyres on a vehicle and driving with them is considered use that reduces the value of the goods.
9.5. If the goods matched the description in the listing, the buyer bears the return transport costs.
9.6. If the goods did not match the description in the listing, the seller bears the return transport costs and the buyer is also refunded the original delivery fee.
9.7. The buyer is refunded the amount paid for the goods no later than 14 days after the goods arrive back at the seller or at a Minurattad.ee service point and their condition has been checked.
9.8. Disputes regarding the condition of the goods are resolved in accordance with the dispute resolution procedure set out in these terms.
10. Seller's responsibility
10.1. The seller is fully responsible for the correctness of the information provided in the listing.
10.2. The seller is required to sell exactly the goods described in the listing.
10.3. The seller is responsible for proper packaging of the goods.
10.4. If the seller knowingly provides false information, Minurattad.ee may cancel the transaction and restrict the user account.
11. Buyer’s responsibility
11.1. The buyer is required to review the contents of the listing before completing a purchase.
11.2. The buyer is required to report any possible problems within a reasonable time after receiving the goods.
11.3. The buyer may not abuse the dispute system or knowingly provide false information.
12. Disputes
12.1. In the event of a dispute, Minurattad.ee may temporarily suspend the payout.
12.2. Minurattad.ee has the right to request additional photos, documents, and evidence from both parties.
12.3. If the goods materially differ from the description in the listing, Minurattad.ee may decide to refund the buyer.
12.4. The final decision in resolving a dispute is made by Minurattad.ee based on the available evidence.
13. Prohibition on circumventing the platform
13.1. If the buyer is found through Minurattad Marketplace, the transaction must be carried out through the Minurattad.ee platform.
13.2. It is prohibited to use listings, photos, or messages for the purpose of carrying out a transaction outside the Marketplace.
13.3. Minurattad.ee has the right to remove listings and restrict users’ access to the platform if an attempt to circumvent the platform is detected.
14. Blocking users
14.1. Minurattad.ee has the right to restrict or close a user account if the user:
- violates these terms;
- provides false information;
- damages the reputation of the platform;
- attempts to avoid paying the service fee;
- uses the platform maliciously.
15. Limitation of liability
15.1. Minurattad.ee is not responsible for the correctness of information published by users.
15.2. Minurattad.ee is not responsible for breaches of agreements concluded between users.
15.3. Minurattad.ee acts as an intermediary for transactions and as a technical platform.
16. Final provisions
16.1. These terms are governed by the law of the Republic of Estonia.
16.2. Minurattad.ee has the right to amend and supplement these terms of use.
16.3. Use of the Marketplace constitutes acceptance of these terms of use.
